syslog error messages

Does anyone know what causes this error message to appear
in /usr/spool/mqueue/syslog?

   Aug 20 17:12:36 log write /dev/console error 9

This is our /etc/syslog.conf:

8/dev/console
8/usr/spool/mqueue/syslog
3/usr/adm/critical

bhoward
puglia
root

My best guess is some sort of tty permission problem.  Since
syslog runs as daemon, it may not always be able to echo errors
of the appropriate level to the console thus generating a syslog
error when it cannot.  Is there a simple solution to this?  Is
it safe to run syslog as root?
